I guess this will only be decided when it is litigated (unfortunately). However the copyright declaration does belong to the producer of the work and not the web site hosting agency. Anything not specifically denoted as falling under Creative Commons would obviously apply to IA's usage policy. How it applies to what I put up under the creative commons though is specified under the license itself and not the web site's usage policy. As you point out if someone emailed me and I sent them the same file it will still be covered under the copyright which I designated when I created the item.
